  1. CASH ASSISTANCE

 Family Independence (FI)/Temporary Assistance for Need Families (TANF) Program

Family Independence is a program administered by Department of Social Services that provides monthly cash assistance to eligible families with children. The Family Independence Program is the name given to our state’s Temporary Assistance to Needy Families (TANF) Program.  Most applicants who apply for FI will be asked to go through a job search.  If the applicant is unsuccessful in obtaining work, then they may be able to receive job training and assistance with job placement. The FI program will pay child care and transportation costs. In addition, families receiving FI will be eligible for Medicaid benefits.  Most recipients may only receive FI for a limited time period, but some families are exempt from these limits.  Once families leave FI because of obtaining a job, they are eligible for Transitional Medicaid and Child Care.  Applicants can apply at their county Department of Social Services office.

 

To be eligible for TANF benefits, applicants must meet income and household requirements.  They must also meet certain citizenship requirements:

  • Immigrants who came to the U.S. before August 22, 1996, are eligible for TANF benefits if they fall into a “qualified” category.  This category includes lawful permanent residents with green cards, refugees, asylees, Cuban/Haitian entrants, persons granted withholding of deportation, conditional entrants, and certain abused immigrants and their families.
  • Immigrants who came to the U.S. after August 22, 1996, are eligible for TANF benefits if they are lawful permanent residents with 40 quarters of work (roughly 10 years of working), members of the military and their families, or victims of severe trafficking.  Also, refugees, asylees, persons granted withholding of deportation, Cuban/Haitian entrants, and Amerasian immigrants are eligible, but only for their first five years in the U.S.

To report abused or neglected children OR adults, call your local county Department of Social Services office.  Each county DSS office is listed by county in the Cash Assistance and Food Assistance sections of this manual.

Nearly one-third of American women report being physically or sexually abused by a husband or boyfriend at some point in their lives.  If you are a victim of domestic violence, there are state-funded centers throughout the state that can help you.  The South Carolina Department of Social Services (DSS) through its Battered Spouse Program has provided assistance for victims of domestic violence for thirty years.  The program provides support for crisis intervention and prevention services to victims of family violence, their children and abusers through a network of community based nonprofit service providers.

The types of providers vary from emergency shelters offering a variety of services to programs that offer specialized services for victims of incest.  There are providers in rural as well as metropolitan areas.  All providers are united in their dedication to ensuring the safety of victims and prevention of further incidents of violence.

The South Carolina Department of Social Services (DSS) was designated by the Governor as the administering agency for the State Battered Spouse Appropriation and Family Violence Prevention and Services Act funds.  The goal of the Department regarding the Battered Spouse and Family Violence Prevention and Services Act Programs is to prevent and/or reduce the incidence of family violence and to ensure accessible emergency shelter and related assistance to those in need of services for the prevention of spouse abuse and family violence.

 

All DSS-funded emergency shelter services are required to provide:

  • a twenty-four hour crisis line;
  • client needs assessment;
  • information and referral;
  • temporary emergency shelter;
  • individual and group counseling;
  • legal advocacy;
  • assistance with obtaining housing and employment;
  • locally based services in each county of the assigned service region;
  • promote community awareness of domestic violence issues.

 

Recipients of these services must be victims of family violence, their children, or offenders.  Family violence is defined as actual or potential physical violence between persons who are related by blood or marriage or otherwise legally related or lawfully residing together.

Those in need are eligible to receive services without regard to income, national origin, or gender.  Emergency shelters may develop house rules that prohibit residence by individuals who exhibit inappropriate or dangerous behavior.

DSS funds a regional network of thirteen emergency shelter programs.  The primary program sites are located in the traditional marketplace center for each region.  Several programs have established satellite locations that offer advocacy and counseling services within their service areas.

Safe Harbor is a 24-hour emergency shelter and crisis line for victims of domestic violence and their children.  The shelter operates 365 days per year, and the maximum stay is 45 days.  The shelter hotline is staffed 24 hours a day, 7 days a week for crisis calls, counseling and information.  For residents, Safe Harbor’s services include professional counseling, both individual and group, food and lodging, laundry facilities, clothing, personal items and other necessities, case management and referrals for medical care, housing, employment, job training, education, childcare and transportation, living skills classes taught by community experts, advocacy, including accompaniment to court appearances, help with protective orders and other legal matters, and after-care for clients who have left the shelter, but who will still need counseling, advocacy, or other support.  For those not seeking shelter, Safe Harbor’s services include individual counseling and community support groups for those living with abuse or for those trying to cope after leaving a destructive relationship, a 24-hour H.E.A.R.T. (Hospital Emergency Aid Response Team) Program to support victims while they are seeking medical treatment and to offer shelter and safety, and the Megan Project, a program for middle and high school students to prevent date violence, to teach healthy relationships, and to support young people living with domestic violence in their homes.

CASA offers individual, group and family counseling for both adults and children. CASA advocates for the rights of victims of family violence by providing support and assistance with the criminal and civil justice systems for victims.  CASA also offers free emergency, temporary shelter for female victims of family violence and their children. While in safety at CASA, residents receive counseling and are offered the support needed to choose a violence-free lifestyle.  CASA offers information and referrals to assist individuals in meeting their needs through utilizing community resources.  CASA offers an in-depth and comprehensive manual for victims and families of domestic violence. The manual is free of charge.  CASA sponsors a six-week counseling program for batterers; the program is not free of charge.

Safe Harbor is a 24-hour emergency shelter and crisis line for victims of domestic violence and their children.  The shelter operates 365 days per year, and the maximum stay is 45 days.  The shelter hotline is staffed 24 hours a day, 7 days a week for crisis calls, counseling and information.  For residents, Safe Harbor’s services include professional counseling, both individual and group, food and lodging, laundry facilities, clothing, personal items and other necessities, case management and referrals for medical care, housing, employment, job training, education, childcare and transportation, living skills classes taught by community experts, advocacy, including accompaniment to court appearances, help with protective orders and other legal matters, and after-care for clients who have left the shelter, but who will still need counseling, advocacy, or other support.  For those not seeking shelter, Safe Harbor’s services include individual counseling and community support groups for those living with abuse or for those trying to cope after leaving a destructive relationship, a 24-hour H.E.A.R.T. (Hospital Emergency Aid Response Team) Program to support victims while they are seeking medical treatment and to offer shelter and safety, and the Megan Project, a program for middle and high school students to prevent date violence, to teach healthy relationships, and to support young people living with domestic violence in their homes.

III.  DRUG AND ALCOHOL SERVICES

 

South Carolina Department of Alcohol and Other Drug Abuse Services

 

The South Carolina Department of Alcohol and Other Drug Abuse Services provides a comprehensive array of services to adults and children who are having problems related to substance abuse.  A statewide system of service delivery was developed through the implementation of Act 301 of 1973, which required each county council to designate an authority to provide mandated services in cooperation with DAODAS.  All of the county authorities offer outpatient treatment, including assessment and referral, individual group and family counseling, case management and crisis management services.  Some of the counties offer additional services as well.

The county authorities serve as the entry point for programs providing more intense levels of care, which are designed to arrest the disabling efforts of the misuse of or addiction to alcohol and/or other drugs.  The following types of programs are provided through the county authorities:

 

  • Halfway houses are geared toward individuals who have left intensive treatment but who are not ready to return to independent life in their community.  Halfway houses provide short-term therapeutic accommodations in a group setting in a structured living environment.  Some of the programs provided include individual, group and family counseling and programs designed to promote stabilization and continued involvement in the treatment process.  The halfway houses are located in Florence, Lexington / Richland, Marion and Sumter counties.

 

  • Inpatient treatment is available for adolescents through the William J. McCord Adolescent Treatment Center in Orangeburg.  This program provides intensive treatment in a controlled setting for adolescents ages 12 through 17.  The program is medically monitored and includes 24-hour physician and nursing care.

 

  • Residential treatment* is available for persons who need more than out-patient treatment as well as other services such as life skills training, parenting education and vocational assistance.  Residential treatment provides 24-hour care.  Medical services are available but are usually not provided on-site.  NOTE.  Some facilities are designed exclusively for women and a limited number of children, and for juvenile criminal offenders.

 

  • Detoxification facilities provide services to individuals experiencing symptoms of physical withdrawal from alcohol or other drugs.  These facilities are available in the following counties: Charleston, Greenville, Horry, Marion, Newberry, Richland, Sumter and York.

 

  • *Referrals can also be made to private inpatient and residential treatment facilities, for individuals with insurance or private payment resources.  Medicaid may be accepted at some private facilities.

 

  • Transitional housing, available in Charleston County, provides safe and supportive housing for women with alcohol and other drug problems and their dependent children.  Outpatient treatment and continuing care services are provided on site.

 

  • Intensive outpatient (IOP) services are available for persons who need counseling or therapy on a daily basis but do not need the structure of an inpatient setting.  Several counties offer these programs.  In addition, several programs offer 1OPs designed specifically for adolescents and women.  Twenty-four of the state’s 34 count alcohol and drug abuse authorities have been approved for reimbursement from Medicaid services for IOP.  Four of the approved programs deliver IOP services specifically for adolescents.  These programs are located in Lexington/Richland, Orangeburg, Spartanburg and Charleston counties.

 

  • Intensive in-home services, available in Charleston, Dorchester and Pickens counties, are designed for preventing disruption of the home environment.  The services are also geared toward avoiding occurrences of child abuse and neglect, promoting reunification of the family and strengthening the family unit.

 

  • Managed care is available for persons who are eligible to receive Medicaid benefits for inpatient and outpatient services.
  • DAODAS and the county authorities offer specialized services exclusively for women and children. Pregnant women are automatically given priority admission. Services range from prevention services that educate the community to residential treatment services.  Along with residential and intensive outpatient treatment discussed above, therapeutic childcare (TCC) is offered in Charleston, Dorchester, Florence and Greenville counties to children up to age six.  The purpose of TCC is to cultivate the physical and emotional well-being of the children.

  • The Bridge program is designed to ease the transition for adolescents between alcohol, drug, juvenile justice and other residential facilities and their families and communities.  The goal of The Bridge program is to improve the adolescent’s life skills.  Adolescents are encouraged to remain in school, get jobs, participate in GED programs and move on to college.  The Bridge is available at the following locations:

  • Building Resilient Children is an educational program targeting parents of elementary and middle school aged children, The program is designed to educate the parents about the following:

(1)   to understand that building resilient children is a key factor in preventing alcohol, tobacco and other drug use;

(2)  understand the characteristics of resilient children; and

(3)  to learn new skills for interfacing with their children.

 

  • The School Intervention Program (SCIP) is a school-linked program that works to reduce – through appropriate interventions – the use of alcohol and other drugs, as well as other related behavioral problems, among students in grades 7 through 12.  SCIP provides comprehensive intervention and treatment services to high-risk students who-are identified by the school system or other community agencies that work with students.  In addition, this statewide program includes a prevention component for students who are at risk but are not currently experiencing alcohol or drug related or other behavioral problems.

 

  • The Omega Therapeutic Community is a justice program for male juvenile offenders.  The program provides residential treatment services for male juvenile offenders who have a history of alcohol or other drug problems.  Services are also provided to juveniles who are released from DJJ and are returning home.

  1. FOOD ASSISTANCE

 

Food Stamp Eligibility

 

The Food Stamps Program is a program administered by the Department of Social Services.  It helps families buy the food they need for a nutritionally-adequate diet. Applicants can apply at their county’s Department of Social Services office.

 

To be eligible for food stamps, applicants must meet income and household requirements. They must also meet certain citizenship requirements. The following groups of immigrants are eligible for food stamps:

 

  • Refugees, persons granted asylum or withholding of deportation, Cuban/Haitian entrants, and Amerasian immigrants;
  • Immigrants who have lived in the U.S. for 5 years in “qualified”* status;
  • Children under 18 who were lawfully residing in the U.S. on August 22, 1996, and are “qualified”* immigrants.  As of October 1, 2003, all “qualified”* children will be eligible regardless of date of entry into the U.S.;
  • Immigrants in the military, veterans, and their spouses and children;
  • Lawful permanent residents (green card holders) with 40 quarters of work.  This includes the work of any spouse during the marriage and parents’ work if the immigrant is under 18;
  • Seniors born before August 22, 1931, who were legally present in the U.S. on August 22, 1996;
  • Hmong and Laotian tribe members who are lawfully present in the U.S.;
  • Members of federally-recognized Indian tribes or American Indians born in Canada.

 

* “Qualified” immigrants include lawful permanent residents (green card holders); refugees; persons granted asylum, withholding of deportation, or conditional entry; persons granted parole in the U.S. for at least one year; Cuban/Haitian entrants; and battered spouses and their families.

 

EVERY FOOD STAMP OFFICE HAS ACCESS TO A SPANISH TELEPHONE INTERPRETER.

Medicaid Eligibility

               

The Medicaid program is a program administered by the Department of Health and Human Services (DHHS) and the Department of Social Services (DSS).  It provides medical and health-related services to those who qualify.  Applicants can apply at their local DHHS or DSS office.  Immigrants must meet income requirements to be eligible for Medicaid.  They must also meet certain citizenship requirements:

 

  • Immigrants who came to the U.S. before August 22, 1996, are eligible for Medicaid if they are lawful permanent residents with green cards, conditional entrants, or certain abused immigrants and their families.  Also, refugees, asylees, Amerasians, Cuban/Haitian entrants, and persons whose deportation has been withheld may receive Medicaid for their first seven years in the U.S.

  1. HOUSING

Public housing provides rental housing to low-income families, elderly people and people with disabilities. The local housing authority owns the housing, and the rent charged is based on how much money a person makes.

 

The local housing authority may also run a Section 8 voucher program. This program also helps low-income families, elderly people, and people with disabilities. With a Section 8 voucher, the person can choose their own housing, as long as it meets the program rules. The government will help the person pay their rent.

 

Only certain immigrants can get publicly funded housing assistance:

  • Immigrants who have a Green Card;
  • Refugees, Asylees, immigrants given relief from removal, and conditional entrants;
  • Immigrants given parole by the USCIS for at least one year;
  • Immigrants lawfully admitted;
  • Victims of trafficking ;
  • Citizens of Micronesia, the Marshall Islands, and Palau.

 

Undocumented immigrants are not eligible for housing assistance.

 

Note, though, that all immigrants can use homeless shelters, school breakfast & lunch programs, emergency shelter/food/clothing, soup kitchens, and meals on wheels.

VII.  LEGAL

 

If you do not have a lawyer, whether you are documented or not, the South Carolina Bar Lawyer Referral Service can give you the name of a lawyer who is willing to meet with you and advise you at a lower rate.  For the name of a lawyer in your area, call the Lawyer Referral Service at (800) 868-2284 statewide or (803) 799-7100 in Columbia.

 

Ask -A-Lawyer volunteers from the South Carolina Bar are also available to answer your legal questions free.  Call toll-free, (888) 321-3644.  They are able to assist both those immigrants who are documented and those who are not.

 

If you are a documented immigrant and have a very low income, your local legal services office may be able to help you.  Your local legal services office will also assist undocumented immigrants if they are the victims of domestic violence, as long as the help they are seeking is related to the abuse.  They can also represent victims of trafficking.  To get in touch with them, call the Legal Assistance Telephone Intake Service for a referral (888) 346-5592 statewide or (803) 744-9430 in Columbia.  If you are unsure of if you will qualify for legal services’ assistance, due to your status, it would be best to call and check to see if they can help you.
